What the Oath Binds
Ce que le Serment engage
The Oath of Allegiance binds the taker to be faithful and to bear true allegiance to the Sovereign, to the Sovereign's Heirs and Successors, according to law. The words "Heirs and Successors" are doctrinally load-bearing: they identify the class from which common-law standing derives. An oath-bound officer is bound not only to the Sovereign in person but to the constitutive class of Heirs and Successors in whom the constitutional order continues.
Le Serment d’allégeance lie celui qui le prête à être fidèle et à porter sincère allégeance au Souverain, à Ses héritiers et successeurs, selon la loi. Les mots « héritiers et successeurs » portent une charge doctrinale : ils désignent la classe dont la qualité pour agir en common law tire sa source. L’officier lié par serment ne l’est pas seulement envers le Souverain en sa personne, mais envers la classe constitutive des héritiers et successeurs en lesquels se perpétue l’ordre constitutionnel.

This is the same Oath taken by every oath-bound officer of the juridic Crown — parliamentarians, judges, peace officers, and Crown counsel alike. The common-law Sheriff takes no lesser oath, and no different one. The Office stands on the same constitutional grounding as every other office that owes allegiance.
C’est le même Serment que prête tout officier lié par serment de la Couronne juridique — parlementaires, juges, agents de la paix et procureurs de la Couronne confondus. Le shérif en common law ne prête pas un serment moindre, ni un serment différent. Le Bureau repose sur le même fondement constitutionnel que tout autre office devant allégeance.

The Oath of Allegiance is continuous with the Anglo-Saxon and Norman oath tradition. It is not a statutory invention of 1867; the Fifth Schedule records it. It carries with it the full weight of the constitutional reception at Confederation.

A Sheriff takes the Oath upon accepting a designation — Federal or regional — and records the taking in the common-law register of the Office. The ceremony is formal, witnessed, and recorded. Details are set out at the Oath Ceremony page.
